Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of Pooldar, including the mobile application, website, credits, content, features, and related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use Pooldar.

1. Eligibility

You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use Pooldar only with the involvement or permission of a parent or legal guardian where required by law.

2. What Pooldar is — and is not

Pooldar is a record-keeping and organizational tool for informal financial records. Pooldar does not determine whether money is actually owed, verify debts, guarantee repayment, guarantee that a payment occurred, collect money for users, enforce obligations, adjudicate disputes, or determine that any user is telling the truth.

Unless a separate feature expressly states otherwise, Pooldar is not a bank, lender, escrow service, payment processor, credit-reporting agency, debt collector, law firm, court, arbitrator, or financial institution. A user-created Pooldar record is not proof that a debt exists, that another person agreed to it, that payment occurred, or that an obligation is legally enforceable.

3. User-to-user disputes

Any debt, repayment, promise, disagreement, scam, misrepresentation, nonpayment, partial payment, false payment claim, forgotten payment, misunderstanding, or dispute between users is solely between the people involved. Pooldar has no duty to investigate, mediate, collect, enforce, validate, or resolve those disputes.

4. No professional advice

Pooldar does not provide legal, financial, accounting, tax, lending, collection, credit, investment, or other professional advice.

5. Accounts and security

You agree to provide accurate information requested during registration and to keep your account credentials secure. Pooldar does not have access to your plaintext password. You are responsible for activity through your account except to the extent applicable law provides otherwise.

6. User content

You are responsible for names, amounts, notes, images, dates, payment claims, debt claims, profile information, and other content you enter or upload (“User Content”). You represent that you have the right to provide your User Content and that it does not violate law or another person’s rights.

7. Limited license needed to operate Pooldar

You retain ownership of your User Content. You grant Pooldar a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, display, format, back up, and otherwise use User Content only as reasonably necessary to provide, operate, secure, support, enforce, improve, and develop the Service, comply with law, and protect Pooldar or others.

8. Credits and in-app purchases

Pooldar may offer consumable credits through Apple’s In-App Purchase system. Credits are licensed digital items, have no cash value, are not legal tender, are not redeemable for cash, and are not transferable between accounts unless Pooldar expressly permits it.

Apple processes App Store purchases and determines eligibility for refunds under Apple’s applicable rules and law. Pooldar does not promise or guarantee that Apple will approve or deny a refund request. See our Refund Policy.

9. Refunded or reversed purchases

If Apple refunds, revokes, or reverses an in-app purchase, Pooldar may revoke unused credits attributable to that transaction, correct an erroneous credit grant, or take reasonable measures to prevent refund or purchase abuse. Pooldar will not intentionally create a negative credit balance solely because of an ordinary Apple-approved refund unless the user has separately agreed to such a mechanism.

10. Pricing and feature changes

Pooldar may change credit prices, package sizes, record costs, features, limits, or the way credits function, subject to applicable law and platform rules. Changes to future purchases do not alter a completed transaction except where required by law or platform rules.

11. Usernames and profiles

Pooldar may set username format rules, change limits, reservation periods, and similar restrictions. To the maximum extent permitted by law, Pooldar may reclaim, modify, reset, disable, or require a username change when reasonably necessary for abuse prevention, impersonation concerns, rights complaints, security, technical reasons, moderation, legal compliance, or operation of the Service.

12. Prohibited conduct

You may not use Pooldar to harass, threaten, intimidate, defame, stalk, exploit, impersonate, scam, deceive, or defraud another person; create intentionally false records for an abusive or unlawful purpose; upload unlawful or infringing content; interfere with the Service; attempt unauthorized access; bypass security or usage limits; distribute malware; scrape or automate access without permission; or use the Service for an unlawful purpose.

13. Moderation and account actions

Pooldar may investigate suspected violations and may remove or restrict content, reset usernames, correct improperly granted credits, limit features, suspend access, preserve evidence, or terminate accounts when reasonably necessary for security, fraud or abuse prevention, legal compliance, enforcement of these Terms, protection of users or third parties, discontinuation of the Service, or legitimate technical or operational reasons. Where permitted by law, action may be taken without advance notice when notice would create security, fraud, abuse, legal, operational, or safety risk.

14. Account deletion

Users may initiate account deletion through Pooldar where available. Deletion is intended to remove the account and associated information Pooldar is not legally required or otherwise permitted to retain. Limited security, fraud-prevention, transaction, legal, dispute, or backup records may remain as permitted by law. Unused consumable credits may be lost when an account is permanently deleted, except where law or Apple’s rules require otherwise.

15. Data availability and loss

You should maintain independent copies of information that is important to you. Pooldar does not guarantee that every account, record, image, credit balance, or other item will always be available, recoverable, complete, or error-free. To the maximum extent permitted by law, Pooldar is not liable for loss or corruption of data caused by events outside Pooldar’s reasonable control. Nothing in these Terms eliminates liability that cannot legally be excluded.

16. Privacy and security

Our Privacy Policy describes Pooldar’s data practices. Pooldar uses reasonable safeguards designed to protect information, but no service can guarantee perfect security. These Terms do not waive privacy, security, breach-notification, consumer-protection, or other rights that cannot lawfully be waived.

17. Third-party services

Pooldar relies on third-party infrastructure and services for functions such as hosting, authentication, databases, transactional email, app distribution, and in-app purchasing. Pooldar does not control third-party outages, platform policies, or independent acts, except to the extent Pooldar remains responsible under applicable law.

18. Intellectual property and copyright

Pooldar’s software, branding, interfaces, graphics, documentation, and other materials provided by Pooldar are owned by or licensed to Pooldar and are protected by applicable law. You may not copy, sell, distribute, reverse engineer, or exploit Pooldar materials except as permitted by law or written permission.

Do not upload profile pictures or other content that you do not own or have permission to use. Copyright or intellectual-property complaints may be sent to verification@pooldarapp.com. Pooldar may remove allegedly infringing content or restrict repeat abuse when appropriate.

19. Changes to the Service and Terms

Pooldar may modify, update, limit, suspend, replace, or discontinue features or portions of the Service. We may update these Terms from time to time. For material changes, we may provide additional notice where appropriate or required. If law requires affirmative consent to a material change, we will follow that requirement. Changes will not retroactively eliminate rights or impose obligations where doing so is prohibited by law.

20. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. POOLDAR DOES NOT WARRANT THAT ANY DEBT EXISTS, THAT ANY PERSON WILL PAY, THAT ANY PAYMENT CLAIM IS TRUE, THAT ANY RECORD IS ACCURATE, THAT ANY USER IS HONEST, OR THAT ANY USER-CREATED RECORD IS LEGALLY ENFORCEABLE.

21. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOLDAR AND ITS OWNERS, OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, BUSINESS, OPPORTUNITIES, GOODWILL, OR DATA; USER-TO-USER DISPUTES; UNPAID DEBTS; FALSE PAYMENT CLAIMS; USER SCAMS; ACCOUNT LOSS; SERVICE INTERRUPTIONS; OR DAMAGES CAUSED BY RELIANCE ON USER-ENTERED INFORMATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOLDAR’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THROUGH THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $50. Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply.

22. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pooldar and its owners, operators, affiliates, licensors, providers, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable legal expenses arising from your User Content, misuse of the Service, violation of these Terms, or violation of another person’s rights.

23. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent another law must apply. Subject to mandatory consumer rights that cannot be waived, disputes relating to these Terms or the Service will be brought in state or federal courts located in Los Angeles County, California.

24. Severability, no waiver, assignment, and force majeure

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. Pooldar may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or by operation of law. Pooldar is not responsible for delay or failure caused by events beyond its reasonable control.
